Acceptable Use Policy

By accessing or using Eloquent AI's Platform Services or associated software, you agree to this Acceptable Use Policy (AUP), which complements the terms of any Services Agreement and/or Eloquent AI's Terms of Use (“Agreement”). All capitalised terms in this AUP hold the same meaning as in the Agreement. If you're using the Platform Services on behalf of an organisation, you confirm that you have the authority to bind that organisation to this AUP, and all references to “you” in this policy apply to your organisation as well. Eloquent AI may update this AUP by posting changes on our website.

Data Protection. When you use the Platform Services to process personal data for your end-users, you act as Controller and Eloquent AI acts as Processor in accordance with our Data Processing Addendum (DPA). The DPA forms part of your agreement with us and prevails to the extent necessary to comply with applicable data protection laws.

For safety, compliance, and platform integrity, Eloquent AI may monitor usage for abuse detection and policy compliance and may suspend or restrict access where a breach is suspected or confirmed.

Eloquent AI may also implement reasonable technical safeguards, filtering mechanisms, rate limits, usage thresholds, access restrictions, or protective controls designed to maintain the security, integrity, availability, compliance, or stability of the Platform Services and related systems.

Prohibited Activities

To maintain the integrity, security, and proper use of Eloquent AI's Platform Services, you agree not to:

1. Interfere with the Platform Services:

Modify, reverse engineer, decompile, disassemble, decrypt, or otherwise attempt to access the human-readable form of the Platform Services.
Create adaptations, translations, or derivative works based on the Platform Services.
Undertake benchmarking or performance testing of the Platform Services or publish comparative results without prior written approval.
Attempt to bypass or defeat model safety features, jailbreak protections, or other safeguards.
Perform penetration testing, vulnerability scanning, adversarial testing, prompt injection testing, red-team activities, or security assessments against the Platform Services without Eloquent AI's prior written approval.

2. Circumvent Usage Restrictions:

Bypass or attempt to bypass user limits or usage restrictions built into the Platform Services.
Remove any proprietary notices, branding, or ownership labels from Eloquent AI's technology.
Circumvent authentication, rate limits, throttling, or usage caps.

3. Unauthorised Sharing or Distribution:

Disseminate, market, sublicense, rent, lease, or lend the Platform Services or any part of it to third parties, or operate a service bureau without consent.

4. Tampering and Unauthorised Access:

Interfere with, disrupt, destroy, or unlawfully access server networks, data, or other assets belonging to Eloquent AI or its partners.
Use the Platform Services to gain unauthorised access to third-party systems, violate third-party terms of service, bypass access controls, or engage in abusive automated interactions with external platforms or services.
Access, process, monitor, or automate any systems, accounts, communications, or data without all necessary rights, authorisations, notices, and consents required under applicable law, contract, or organisational policy.
Use the Platform Services in restricted or sanctioned countries or territories or access features where such use is prohibited.
Upload malware, malicious prompts, or other content intended to degrade security or performance.

5. Unethical Use:

Use the Platform Services to build competitive products, copy ideas, or replicate features.
Use the Services, outputs, workflows, operational behaviour, or data generated through the Services to:
- train, fine-tune, evaluate, benchmark, or improve any artificial intelligence, machine learning, or competing automation system;
- create datasets, synthetic datasets, or derivative training materials for use in competing products or services; or
- replicate or attempt to replicate the functionality, behaviour, workflows, or operational logic of the Services.
Input malicious prompts or attempt to manipulate the Platform Services to:
a) generate harmful, illegal, or offensive content;
b) reveal sensitive or confidential information;
c) deviate from its intended programming.

6. Improper Use of Generative AI Features:

Generate medical, legal, financial, immigration, or other professional advice or portray outputs as such.
Produce content that could lead to biased or unfair treatment of individuals or protected classes.
Make solely automated decisions that produce legal or similarly significant effects on an individual without appropriate human review, transparency, and a lawful basis. Customer is responsible for ensuring that any legally required notices, disclosures, consents, or transparency obligations relating to the use of artificial intelligence or automated systems are properly implemented and maintained.
Use the Platform Services as the sole basis for decisions requiring legally mandated human oversight, professional judgment, regulatory approval, or licensed professional review where such oversight is required by applicable law. Customer remains solely responsible for all business, compliance, legal, underwriting, fraud, payment, servicing, customer-support, and regulatory decisions made using the Platform Services, including ensuring appropriate human oversight and review where required by applicable law or industry standards.
Use the Platform Services in situations where failure, inaccuracy, delay, or unavailability could reasonably be expected to result in death, bodily injury, emergency response failures, or other critical safety harms unless expressly approved by Eloquent AI in writing.
Mislead others by claiming generative AI outputs were created by humans; create synthetic/edited media (deepfakes or voice clones) without clear labelling and all required consents.
Use the Platform Services to impersonate individuals or organisations, conduct phishing or social engineering activities, misrepresent automated systems as humans where disclosure is legally required, or engage in fraudulent, deceptive, or misleading conduct.

High-Risk and Harmful AI Uses

Use the Platform Services for:

unlawful surveillance, social scoring, or discriminatory profiling;
exploitation of vulnerable individuals or groups;
generation or dissemination of knowingly false or misleading information intended to cause harm;
unlawful biometric identification or processing;
activities involving child exploitation, human trafficking, terrorism, or violence;
development or deployment of malicious code, malware, or cyberattack capabilities; or
any use prohibited under applicable artificial intelligence, consumer protection, financial services, or data protection laws.

7. General Misuse:

Engage in activities that infringe on Eloquent AI's intellectual property rights or those of third parties.
Violate any applicable laws, including export control and sanctions regulations.
Use the Platform Services for the benefit of any individual, entity, organisation, or jurisdiction subject to applicable sanctions, export restrictions, anti-money laundering laws, or trade compliance prohibitions imposed by the United States, United Kingdom, European Union, or other applicable governmental authority.
Use the Platform Services in a manner that would cause Eloquent AI or its third-party infrastructure, cloud, artificial intelligence, or model providers to violate applicable laws, regulations, contractual obligations, or provider usage policies.
Conduct fraudulent, harmful, deceptive, defamatory, harassing, or abusive activities.
Compromise network security, crack passwords, or circumvent encryption.
Send unsolicited or unlawful communications, including spam or non-compliant telemarketing messages.
Automate processes, such as spam or unauthorised data scraping, that interfere with the Platform Services' performance.
Deploy or configure the Platform Services in a manner that creates uncontrolled, recursive, self-replicating, or autonomous execution loops that may materially impact platform stability, security, performance, or third-party systems.

8. Prohibited Data (do not submit): Unless expressly permitted in a signed Services Agreement and implemented with appropriate safeguards, do not input:

Special-category/sensitive data (e.g., health, biometric/faceprints/voiceprints, precise geolocation, union membership, racial/ethnic origin), children's data, or criminal-records data;
Payment card data beyond truncated PAN or tokenised values;
Government-issued identifiers (e.g., full passport/SSN/NINO) except where strictly necessary and lawfully justified;
Credentials and secrets (e.g., seed phrases, private keys, API client secrets, production passwords/SSH keys);
Data subject to ITAR, classified controls, or other export-restricted regimes.

Limited Exception for Testing

You may evaluate and configure your authorised instance of the Platform Services for legitimate internal business purposes in ways that might otherwise violate this AUP, provided that:

Such activities do not materially impact the security, integrity, availability, performance, or lawful operation of the Platform Services or third-party systems;
You promptly report to Eloquent AI any:
- security vulnerabilities;
- harmful or illegal content;
- unauthorised exposure of third-party confidential information.

You remain responsible for ensuring compliance with all applicable laws related to the content you handle, including retention, destruction, and reporting requirements.

Reporting Abuse

Report abuse, security issues, or policy concerns to privacy@eloquentai.co (include timestamps, request IDs, and relevant logs to assist investigation).

Enforcement

Eloquent AI reserves the right to investigate suspected violations of this Acceptable Use Policy and may suspend, restrict, or terminate access to the Platform Services for actual or suspected violations of this AUP, applicable law, security requirements, or regulatory obligations.

Eloquent AI may take reasonable technical, operational, or legal measures necessary to protect the security, integrity, availability, or lawful operation of the Platform Services, its customers, third-party systems, or the public.

Survival

The restrictions, obligations, enforcement rights, intellectual property protections, confidentiality obligations, and liability limitations contained in this AUP shall survive suspension or termination of access to the Platform Services.
